When I first launched my online business, I was excited about everything—the products, the website, and the potential customers. But there was one thing I didn’t think about initially: trademarking my brand. It wasn’t until I saw a competitor pop up with a very similar name that I realized how important it is to protect your brand. Trust me, you don’t want to end up in a situation where someone else owns the rights to your business name or logo.


So, how do you trademark your brand and avoid those scary legal issues? Let me walk you through it, based on my own journey.


A trademark is a legal protection for your brand’s identity—whether it’s your name, logo, slogan, or even a unique product shape. Essentially, it gives you exclusive rights to use those elements in your business and prevents others from using similar names or logos in a way that could confuse customers.


For example, when I started selling T-shirts, I created a logo with a unique font and design. At first, I thought, "No one will copy this, it’s so unique." But after seeing a few online shops using a similar style, I realized I needed to make sure my logo was protected.


Before registering, it's crucial to check if your brand name or logo is already taken. There’s nothing worse than spending time and money building a business only to find out you can’t legally use your brand name.


I learned this the hard way. I almost used a name that sounded great but didn’t check for existing trademarks. Luckily, I did a quick search on the U.S. Patent and Trademark Office (USPTO) website (or the relevant trademark office for your country), and found that someone else had already registered it. If I hadn’t, I could have faced legal action down the road.


Once I found a unique name and logo, I went ahead with the registration process. This involves filing an application with the relevant trademark office. In the U.S., it’s the USPTO, but if you’re in another country, the process will be similar with a local trademark office.


When I filed my trademark, it was pretty straightforward. You’ll need to provide details like:


  • Your brand’s name, logo, or slogan.
  • The class of goods or services your trademark will cover (for example, clothing, marketing services, etc.).
  • A sample of how your trademark will appear in commerce (like your website or product packaging).

After submitting, you’ll have to wait for the trademark office to review your application. This can take a few months. During this period, they may ask for additional information or clarification. If everything goes smoothly, your trademark will be approved, and you’ll have exclusive rights to your brand.


When my trademark was approved, I felt a huge sense of relief knowing my brand was officially protected. I no longer had to worry about someone else using my name or logo to confuse customers or steal my idea.


Getting a trademark is just the beginning. You need to keep an eye out for anyone using your brand without permission. This can be a little tricky, but I use tools to monitor trademarks and set up Google Alerts for my brand name. If I find any violations, I can send a cease and desist letter or take legal action if needed.


Trademarks aren’t permanent unless you keep them active. For example, in the U.S., you need to file maintenance documents and pay fees at regular intervals (usually every 5-10 years). It’s something I always put on my to-do list to make sure my trademark stays in good standing.
