⍰ ASK What is the role of tax treaties in offshore tax and legal structures, and how do they impact a company's tax liabilities?

Tax treaties, also known as double tax agreements (DTAs), play a crucial role in offshore tax and legal structures by providing a framework for cross-border tax cooperation between countries. They aim to reduce the risk of double taxation by determining the taxation rights of each country with respect to cross-border transactions and provide a set of rules for determining the tax liabilities of residents and non-residents.

When a company operates in multiple countries, it is possible for the same income to be taxed in more than one country, leading to double taxation. Tax treaties help to resolve this issue by allocating the taxation rights between the countries involved, based on the residency of the company and the source of the income.

For example, if a company is resident in one country and operates in another country, the tax treaty between these two countries may provide that the company's income from the second country is taxed in that country, while the company's income from the first country is taxed in its country of residence.
